Do's and don'ts when involved in a car accident:

  • Always wait for the police, if you are injured.  Unless you leave by ambulance before they arrive

  • Always get witnesses’ information, if possible
  • Never chase the other driver
  • Never threaten the other driver
  • Never talk to the other driver’s insurance company
  • Never talk to a lawyers’ office that simply “heard” about your accident

Traffic Citations

Most traffic accidents do not lead to the police issuing anyone a traffic citation. But, if the other driver does get a ticket, we recommend someone on your behalf appearing in court to make sure your side of the story is told to the Judge/hearing officer to better advance your position as your case proceeds in our office. Even if no one gets a ticket, we can still proceed with your case based upon your version of the facts of the accident. We compare the police report to your story and our knowledge about the roadways involved to give you a sound opinion about our ability to win your case.

If you get a citation, that does not mean we can’t win your case. A ticket for not having insurance does not affect your case for your injuries at all. Many of our clients do not have car insurance, and we win. Many of our clients who were involved in an accident did not have a valid driver’s license. That does not mean we can’t win your case.

Uninsured Motorist Cases

In most cases, as long as you have insurance, then your insurance policy will provide uninsured motorist coverage for the accident. If the other driver did not have insurance, first, we have to show your insurance company that they did not have insurance. Then, we can proceed with your case against your insurance company to compensate you for your injuries. Your insurance company will look to protect itself and we need to do all the fighting for you so you can get what you deserve.

We do not actually “sue” your insurance company, but there is a process where your rights and their rights are examined by decision-makers. The same process occurs even if you are the victim in a hit-and-run accident; your insurance company will manage your case as an uninsured motorist claim.

What if I don't have medical insurance?

Many of our clients do not have medical insurance.  For those clients, we work with several medical professionals who will provide the treatment our clients need.  The medical professionals do not expect any payment for the treatment until the case is resolved.  

For all of our clients, we have a list of trusted medical professionals who we recommend to our clients when they are unsure who they should trust to provide the medical care associated with their injury.  

At the end of each case, we negotiate with all medical professionals to minimize the amount of money owed and maximize the amount of money our clients receive.

What if I am hit by a truck?
